Terms and Conditions

1. About Tinta

These Terms and Conditions ("Terms") govern your access to and use of the Tinta mobile application and web application (collectively, the "Service"), operated by:

By downloading, installing, or using Tinta, you agree to these Terms. If you do not agree, please do not use the Service.

2. Description of the Service

Tinta is an AI-powered personal color analysis application. The Service analyzes photos submitted by users to determine their personal "color season" (e.g., Warm Autumn) and provides personalized recommendations for clothing colors, makeup, and styling.

The results provided by Tinta are AI-generated suggestions for aesthetic purposes only. They are not medical advice, psychological assessments, or professional styling consultations. Results may vary and are not guaranteed to be accurate for every individual.

3. Eligibility

You must be at least 16 years old to use Tinta. By using the Service, you represent and warrant that:

  • You are at least 16 years of age
  • You have the legal capacity to enter into a binding agreement
  • You are not prohibited from using the Service under applicable law

If you are under 18, you confirm that you have obtained the consent of a parent or legal guardian.

4. Account Registration

You may need to create an account to access certain features. You agree to:

  • Provide accurate and complete information during registration
  • Keep your login credentials confidential
  • Notify us immediately at support@tinta.style of any unauthorized use of your account
  • Be responsible for all activity that occurs under your account

We reserve the right to terminate accounts that provide false information or violate these Terms.

5. Subscriptions and Payments

5.1 Subscription Plans

Access to the full features of Tinta requires a paid subscription. Current pricing:

  • Mexico: $99 MXN per week
  • Other markets: as displayed at the time of purchase

Prices are inclusive of applicable taxes unless stated otherwise. We reserve the right to change pricing with 30 days' notice to existing subscribers.

5.2 Billing

Subscriptions are billed on a recurring basis (weekly) and renew automatically until cancelled. By subscribing, you authorize us (or the relevant app store platform) to charge your payment method on each renewal date.

Payment processing is handled by Stripe, Apple App Store, or Google Play, depending on how you subscribe. Their respective terms and policies apply to payment processing.

5.3 Free Trials

If you activate a free trial, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.

5.4 Cancellation

You may cancel your subscription at any time:

  • Via App Store: through your Apple ID subscription settings
  • Via Google Play: through your Google Play subscription settings
  • Via web: through your account settings at app.tinta.style

Cancellation takes effect at the end of the current billing period. You retain access to paid features until the period ends. Cancelling does not entitle you to a refund for the current billing period, except where required by applicable consumer protection law (see Section 5.5).

5.5 Refunds

  • EU/EEA users: Under EU consumer law, you have a 14-day right of withdrawal from the date of initial purchase, unless you have explicitly requested that the service begin immediately and acknowledged that this waives your withdrawal right.
  • Mexico: Refunds may be available in accordance with the Ley Federal de Protección al Consumidor (PROFECO rules). Contact support@tinta.style for refund requests.
  • App Store / Google Play purchases: Refunds are governed by the respective platform's refund policy. We have no control over refunds for in-app purchases made through these platforms.

6. User Content and Photos

6.1 Your Photos

You retain full ownership of any photos you submit to Tinta.

By submitting a photo, you grant HYRE Talent Sourcing and Matching GmbH a limited, non-exclusive, royalty-free license to process and analyze the photo solely for the purpose of providing you with your color analysis result. This license does not extend to:

  • Sharing your photo with third parties for any purpose other than AI processing
  • Using your photo in marketing or promotional materials
  • Training AI models on your photo without separate explicit consent

6.2 Accuracy of Submissions

You agree to submit only photos that:

  • Depict yourself (not another person without their consent)
  • Are taken in natural lighting as recommended in the app for accurate results
  • Do not contain offensive, illegal, or third-party copyrighted content

6.3 Photo Deletion

You may delete your submitted photos and analysis results at any time from your account settings or by contacting us at privacy@tinta.style.

7. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Submit photos of other people without their explicit consent
  • Attempt to reverse engineer, decompile, or disassemble the app or its AI models
  • Use automated tools, bots, or scrapers to access the Service
  • Create multiple accounts to circumvent restrictions or extend free trials
  • Share, sell, or transfer your account to another person
  • Introduce viruses, malware, or any other harmful code
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure

Violation of these rules may result in immediate termination of your account without refund.

8. Intellectual Property

All content, design, code, AI models, branding, and materials in the Tinta app and website — including the Tinta name, logo, and color analysis methodology — are the exclusive property of HYRE Talent Sourcing and Matching GmbH or its licensors, protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, personal, non-transferable, non-sublicensable license to use the Service for your own personal, non-commercial purposes. Nothing in these Terms transfers any intellectual property rights to you.

9. Third-Party Services

The Service integrates with third-party platforms and services, including Apple App Store, Google Play, Stripe, Mixpanel, and Meta Platforms, Inc. (Meta Pixel on the web and Meta SDK in the iOS app). These third parties have their own terms of service and privacy policies, which apply independently of these Terms. We are not responsible for the practices or content of third-party services. See our Privacy Policy for details on what data is shared and how to opt out (including App Tracking Transparency on iOS).

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW:

  • We do not warrant that the Service will be uninterrupted, error-free, or free of viruses
  • Color season analysis results are AI-generated suggestions and may not be accurate for every user
  • Results should not be interpreted as medical, dermatological, or professional fashion advice
  • We do not guarantee that following our color recommendations will achieve any specific aesthetic outcome

11. Limitation of Liability

To the fullest extent permitted by applicable law, HYRE Talent Sourcing and Matching GmbH and its directors, employees, and licensors shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, goodwill, or other intangible losses
  • Damages arising from unauthorized access to or alteration of your data
  • Any damages exceeding the amount you paid us in the 3 months preceding the claim

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any liability that cannot be excluded by law.

EU/EEA consumers: Your statutory consumer rights under applicable EU law are not affected by this limitation.

12. Indemnification

You agree to indemnify, defend, and hold harmless HYRE Talent Sourcing and Matching GmbH and its directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit.

13. Termination

13.1 By You

You may stop using the Service and close your account at any time through your account settings or by emailing support@tinta.style.

13.2 By Us

We may suspend or terminate your access to the Service, with or without notice, if:

  • You materially breach these Terms
  • We are required to do so by law
  • We decide to discontinue the Service

Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 10, 11, 12, and 14 survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions.

For EU/EEA consumers: You may also benefit from the mandatory consumer protection provisions of the country in which you reside.

For Mexican consumers: Your rights under the Ley Federal de Protección al Consumidor (PROFECO) and other applicable Mexican consumer protection law are not affected.

Disputes: We encourage you to contact us first at support@tinta.style to resolve any disputes informally. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany, unless mandatory consumer protection law in your country of residence requires otherwise.

EU Online Dispute Resolution: The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board, but we encourage direct resolution.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect.

If you continue using the Service after the effective date of revised Terms, you accept the updated Terms. If you do not agree, you must cancel your subscription and stop using the Service.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HYRE Talent Sourcing and Matching GmbH regarding the Service and supersede any prior agreements.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
